ROSTA FAMILY LIMITED PARTNERSHIP, JEROME REISMAN, AND NIVEA RIBAS Defendants CIVIL NO 16 1816 (ADC) RE: COLLECTION OF MONIES MORTGAGE FORECLOSURE NOTICE OF SALE TO: ROSTA FAMILY LIMITED PARTNERSHIP, JEROME REISMAN, AND NIVEA RIBAS WHEREAS: Judgment in favor of Plaintiff to recover from Defendants the sum of $165,221.53 in principal $100,670.22 in interest, $30,865.04 in escrow overdraft, $72,980.52 for legal fees, $7,142.12 in unpaid late charges, $61.57 for March 2025 late charges, and $13.00 for an inspection charge.The records of the case and of these proceedings may be examined by interested parties at the Office of the Clerk of the United States District Court, Federal Building, Chardon Avenue Hato Rey, Puerto Rico. WHEREAS: Pursuant to the terms of the judgment and the order of execution thereof, the following property belonging to the defendants will be sold at public auction: Apartment: 202 OF BUILDING D STREET 8. Area: 180.278 Square Meters. Residential Apartment identified with number two hundred two (202), in Building D of Costa Dorada Street number 8, located on the second floor and a terrace on the third floor (roof top) of the building, in the complex known as Costa Dorada Condominium, located in Mameyes Ward of the municipal terrn of Rio Grande, Puerto Rico. It has a total superficial area of one thousand nine hundred forty point fifty (1,940.50) square meters, equivalent to one hundred eighty point two seventy eight (180.278) square meters, from which area one thousand eight hundred forty two point seventeen (1,842.17) square meters, are the area on the second floor and ninety eight point thirty three (98.33) square feet equivalent to nine point thirteen (9.13) square meters, are in the area of the covered terrace on the third floor (roof top. The area on the second floor borders on the North: in a distance of sixteen point twenty six (16.26) lineal meters, with exterior elements; on the South: in a distancer of sixteen point ninety seven (16.97) lineal meters, with common elements, area of the stairs and exterior elements; on the East: in a distance of thirteen point fourteen (13.14) lineal meters, with apartment 201 D and exterior elements; and on the West: in a distance of twelve point seventy five (12.75) lineal meters, with external elements and a dividing wall that separates the balcony from apartment number 201 C. It has three (3) bedrooms, two (2) bathrooms, two (2) closets, a walk in closet foyer, living dining room, kitchen, laundry, hall half a bathroom, balcony and a covered terrace. Its principal access door is located on its South side. The area of the covered terrace that is located on the third floor (roof top), that belongs to this apartment; borders on the North: with a downward open area and/or toward the second floor and an uncovered terrace area; on the South: with a stairs area leading to the second floor; on the East: with common elements; and on the West: with an open terrace area. This covered terrace area has half a bathroom. The use and enjoyment of an open terrace located on the third floor (roof top) also belongs to this apartment, that has a superficial area of seven hundred ten point eighty one (710.81) square feet; bordering on the North: with exterior elements; on the South: with an open downward area and/or toward the second floor, an open terrace area and exterior elements; on the East: with exterior elements, an area of the roof top of the building, an open downward area and/or toward the second floor and a covered terrace area; and on the West: with exterior elements. An area to be dedicated to a future kitchen is found in this open terrace. Zero point eighty five (0.85) is the corresponding percentage of participation in the general common elements. The use of two (2) parking spaces for autos corresponds for use and enjoyment, marked with numbers twenty seven (27) and twenty eight (28) and, also, a space marked with number thirteen (13) for a GOLF car corresponds to it. Plot number 27,828 of Río Grande, Property Registry of Carolina III. Plaintiffs mortgage in the amount of $200,000.00 was recorded at the Registry of the Property of Puerto Rico, property number 27,828. WHEREAS: This property is subject to the liens duly registered at the Registry of Property: Potential bidders are advised to verify the extent of preferential liens with the holders thereof. lt shall be understood that each bidder accepts as sufficient the title and that prior and preferential liens to the one being foreclosed upon, including but not limited to any property tax, liens, (express, tacit, implied or legal) shall continue in effect it being understood further that the successful bidder accepts them and is subrogated in the responsibility for the same and that the bid price shall not be applied toward their cancellation. WHEREAS: For the first judicial sale, the minimum bid agreed upon by the parties in the mortgage deed will be $200,000.00 for the first mortgage and no lower offer will be accepted. Should the first judicial sale of the above described property be unsuccessful, then the minimum bid for the property on the second judicial sale will be $133,333.33, which is two thirds of the amount of the minimum bid for the first judicial sale. The minimum bid for a third judicial sale, if the same is necessary, will be $100,000.00, which is one half of the minimum bid agreed upon the parties in the mortgage deed. (30 LPPA 2721, Mortgage and Property Registry Act, Act. No. 198, Article 221, as amended) WHEREAS: Said sale is to be made by the Special Master subject to confirmation by the United States District Court for the District of Puerto Rice and the deed of conveyance and possession of the property will be executed and delivered only after such confirmation. NOW THEREFORE, public notice is hereby given that the Special Master, pursuant to the provisions of the Judgment hereinbefore referred to will, the first sale date on the July 10, 2026 at 10:00 am of said day, in 134 Mayagüez Street, San Juan, PR 00917, or any other place designated by him, in accordance with 28 U.S.C. 2001, sell at public auction to the highest bidder, the property described herein, the proceeds of said sale to be applied in the manner and form provided by said judgment. Should the first judicial sale set hereinabove be unsuccessful, the second judicial sale of the property described in this Notice will be held on July 17, 2026 at 10:00 am of said day, in the Office located at the address indicated above. Should the second judicial sale set hereinabove be unsuccessful, the third judicial sale of the property described in this Notice will be held on July 24, 2026 at 10:00 am of said day, in the Office located at the address indicated above. THEREFORE, Special Master appointed by the Court to proceed forthwith and to sell at public auction to the highest bidder the property referred to in the judgment.
